Terms of Service

1. Agreement to Terms

By accessing or using NATIONCLASH ("the Service"), operated by NATIONCLASH ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

NATIONCLASH is a satirical, gamified leaderboard platform where users can select a country, purchase symbolic virtual military equipment using in-app credits, and compete on a global leaderboard ranked by military power scores. The platform has a charitable mission: 80% of all purchase revenue is donated to humanitarian relief organizations (UNHCR, ICRC, WFP, and UNICEF).

Important: All equipment, weapons, strikes, and military references within NATIONCLASH are entirely symbolic and satirical. No real weapons, military assets, or destructive capabilities are created, sold, distributed, or used. The Service is an entertainment platform with a charitable purpose.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account and make purchases on NATIONCLASH. By creating an account, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts that we reasonably believe are operated by underage users.

4. Account Registration

• You must provide a username (3–20 alphanumeric characters or underscores) and a password (minimum 8 characters) to create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Accounts are personal and non-transferable. You may not share, sell, or transfer your account to another person.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Credits & Purchases

• NATIONCLASH uses an in-app currency called "credits." Credits are purchased with real money at a fixed rate of $1 USD = 100 credits, with a minimum purchase of $1.
• All payments are processed by our Merchant of Record, Polar.com. By making a purchase, you also agree to Polar's Terms of Use and Privacy Policy.
• Polar handles tax calculation, collection, and remittance for all transactions. Prices displayed may be converted to your local currency at checkout.
• Credits are delivered to your account instantly upon successful payment confirmation.
• Credits have no cash value, cannot be exchanged for real money, and are non-transferable between accounts.
• Credits do not expire. However, if your account is terminated for violations of these Terms, any remaining credits may be forfeited.
• All purchases are one-time transactions. There are no subscriptions, auto-renewals, or recurring charges.

6. Revenue & Charitable Donations

80% of every credit purchase is allocated to humanitarian relief organizations: UNHCR, ICRC, World Food Programme (WFP), and UNICEF. The remaining 20% covers platform operating costs including hosting, development, payment processing fees, and maintenance. Charitable donations are made at our discretion and may be distributed among the named organizations in varying proportions.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to exploit, hack, reverse-engineer, or disrupt the Service, its servers, or its infrastructure.
• Use automated tools, bots, or scripts to interact with the Service.
• Create multiple accounts to circumvent rate limits or other restrictions.
• Impersonate another person or entity.
• Engage in harassment, hate speech, or abusive behavior toward other users.
• Use the Service to promote real violence, terrorism, or any form of real-world military aggression.
• Attempt to buy, sell, or trade credits or accounts outside of the Service.

8. Intellectual Property

All content, design, graphics, code, and trademarks associated with NATIONCLASH are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent. Your use of the Service does not grant you any ownership rights in the platform or its content.

9. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• We are not responsible for any loss of credits or account data due to technical failures, except where caused by our gross negligence.
• All military references, equipment names, and country rankings are satirical and for entertainment purposes only. They do not represent any endorsement of real military activity.

10. Limitation of Liability

To the maximum extent permitted by law, NATIONCLASH and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

11. Refunds

Refund eligibility is governed by our Refund Policy. Please review it before making a purchase.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Unspent credits in a terminated account may be forfeited. You may also delete your account at any time by contacting support.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts located in Delaware, United States.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
